General terms and conditions for purchases

Definitions

In these terms and conditions the following terms shall have the following meanings:

  1. Blèzi Cosmetics: the direct sales company Blèzi Cosmetics, which makes the website www.blezi.com available to its Business Partners and consumers;
  2. Business Partner: the direct seller, being any natural person or legal entity who has entered into an agreement as a reseller with Blèzi Cosmetics and purchases products from Blèzi Cosmetics and subsequently sells them as an independent entrepreneur to the consumer;
  3. Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with Blèzi Cosmetics and/or Business Partner;
  4. Distance contract: an agreement whereby, within the framework of a system organised by Blèzi Cosmetics for the distance sale of products and/or services via Blèzi Cosmetics, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication;
  5. Remote communication technology: means that can be used to conclude an agreement, without the consumer and Blèzi Cosmetics being in the same room at the same time;
  6. Website: the website of Blèzi Cosmetics on which Blèzi Cosmetics makes an offer to the consumer and/or one of its Business Partners and can conclude a distance contract with the consumer or Business Partner;
  7. Reflection period : the period within which the consumer can make use of his right of withdrawal;
  8. Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period;
  9. Day: calendar day;
  10. Durable medium: any instrument that enables the consumer, Business Partner or Blèzi Cosmetics to store information addressed personally to them in a way accessible for future consultation and unaltered reproduction of the stored information.

 

Applicability

  1. These general terms and conditions apply to every offer from Blèzi Cosmetics via the website and to every distance contract concluded between Blèzi Cosmetics and the consumer or Business Partner.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer or Business Partner via the website.
  3. The distance contract is concluded between Blèzi Cosmetics and the consumer or Business Partner.
  4. Consumers can only place orders through the website or their Business Partner. Blèzi Cosmetics is not a party to orders placed through a Business Partner.

 

The offer

  1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
  2. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer or Business Partner to properly assess the offer. If images are displayed on the website, they are a true representation of the products and/or services offered. Obvious errors or mistakes in the offer are not binding on Blèzi Cosmetics.

 

The agreement

  1. Subject to the provisions of paragraph 4, the agreement is concluded at the time the consumer or Business Partner accepts the offer and meets the conditions set therein.
  2. If the consumer or Business Partner has accepted the offer electronically, Blèzi Cosmetics will immediately confirm receipt of acceptance of the offer electronically.
  3. Blèzi Cosmetics may, within legal frameworks, investigate whether the consumer or Business Partner can, in principle, meet their payment obligations, as well as all facts and factors relevant to responsibly entering into the distance contract. If, based on this investigation, Blèzi Cosmetics has good reason not to enter into the contract, it is entitled to reject an order or request with reasons or to impose special conditions on its execution.
  4. Blèzi Cosmetics will include the following information with the product or service to the consumer or Business Partner, in writing or in such a way that it can be stored by the consumer or Business Partner in an accessible manner on a durable data carrier:

a. the postal address where the consumer or Business Partner can submit complaints;
b. the conditions under which and the manner in which the consumer or Business Partner can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
c. information about existing after-sales service and guarantees;
d. the data included above under “The Offer”, unless Blèzi Cosmetics has already provided this data to the consumer or Business Partner prior to the execution of the agreement;
e. the requirements for terminating the agreement if the agreement has a duration of more than one year or is of indefinite duration.

5. If Blèzi Cosmetics has committed to supplying a series of products or services, the provision in the previous paragraph only applies to the first delivery.

 

Right of withdrawal upon delivery of products

  1. When purchasing products, the consumer or Business Partner has the right to cancel the agreement without giving reasons within fourteen business days. This period begins on the day after the consumer or Business Partner receives the product.
  2. During this period, the consumer or Business Partner will handle the product and packaging with care. They will only unpack or use the product to the extent necessary to assess whether they wish to keep it. If they exercise their right of withdrawal, they will return the product with all accessories supplied and – if reasonably possible – in its original condition and packaging to Blèzi Cosmetics, in accordance with the reasonable and clear instructions provided by Blèzi Cosmetics.
  3. If the consumer or Business Partner exercises their right of withdrawal, they will be responsible for at most the costs of return.
  4. If the consumer or Business Partner has paid an amount, Blèzi Cosmetics will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.
  5. If the consumer or Business Partner does not have a right of withdrawal, this can only be excluded by Blèzi Cosmetics if Blèzi Cosmetics has clearly stated this in the offer, at least in good time before the conclusion of the agreement.
  6. In any case, if the sealed packaging of products has been broken, the right of withdrawal shall be deemed to have expired.

 

The price

  1. During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes resulting from changes in statutory regulations and/or provisions.
  2. Notwithstanding the previous paragraph, Blèzi Cosmetics may offer products or services with variable prices, the prices of which are subject to fluctuations in the financial market over which Blèzi Cosmetics has no control. This subjection to fluctuations and the fact that any stated prices are target prices will be stated in the offer.
  3. Offers and/or discounts as displayed on the website are only valid for the duration of the advertised offer and/or discount as stated on the website. Products or services that are not available during the applicable period of the advertised offer and/or discount are excluded from the offer and/or discount as displayed on the website.
  4. The prices stated in the offer of products or services include VAT.

 

Conformity and Warranty

  1. Blèzi Cosmetics guarantees that the products and/or services comply with the distance contract, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations in force on the date the distance contract is concluded.
  2. Any guarantee offered by Blèzi Cosmetics, the manufacturer, or the importer does not affect the rights and claims that the consumer or Business Partner can assert against Blèzi Cosmetics under the law and/or the distance contract in connection with a failure to fulfill Blèzi Cosmetics' obligations.

 

Delivery and execution

  1. Blèzi Cosmetics will exercise the utmost care when receiving and executing orders for products and when assessing requests for the provision of services.
  2. The place of delivery is the address that the consumer or Business Partner has provided to Blèzi Cosmetics.
  3. Blèzi Cosmetics will fulfill accepted orders expeditiously, but no later than thirty (30) days, unless a longer delivery period has been agreed upon. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer or Business Partner will be notified of this no later than one month after placing the order. In that case, the consumer or Business Partner has the right to terminate the agreement without penalty and is entitled to any compensation.
  4. In the event of termination in accordance with the previous paragraph, Blèzi Cosmetics will refund the amount, excluding shipping costs, paid by the consumer or Business Partner as soon as possible, but no later than thirty (30) days after termination.
  5. If delivery of an ordered product proves impossible, Blèzi Cosmetics will endeavor to provide a replacement item. The replacement item will be clearly and comprehensibly communicated upon delivery. The right of withdrawal cannot be excluded for replacement items. Return shipping costs are the responsibility of the consumer.
  6. The risk of damage and/or loss of products rests with Blèzi Cosmetics until the moment of delivery to the consumer or Business Partner, unless expressly agreed otherwise.

 

Payment

  1. Unless otherwise agreed, amounts owed by the consumer or Business Partner must be paid no later than fourteen (14) days after delivery of the product.
  2. The consumer or Business Partner has the duty to report any inaccuracies in payment details provided or stated to Blèzi Cosmetics without delay.
  3. In the event of non-payment by the consumer or Business Partner, Blèzi Cosmetics has the right, subject to legal restrictions, to charge reasonable costs made known to the consumer or Business Partner in advance.

 

Complaints procedure

  1. Complaints regarding the performance of the agreement must be submitted to Blèzi Cosmetics within a reasonable time, fully and clearly described, after the consumer or Business Partner has discovered the defects.
  2. Complaints submitted to Blèzi Cosmetics will be answered within fourteen (14) days from the date of receipt. If a complaint requires a foreseeably longer processing time, Blèzi Cosmetics will respond within fourteen (14) days with an acknowledgement of receipt and an indication of when the consumer or Business Partner can expect a more detailed response.

 

Additional or deviating provisions

Additional or deviating provisions from these terms and conditions may not be detrimental to the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier. Business Partners have a separate agreement.
